Gah, ask before you use my song. It’s fine this time, but be more careful in the future.
I know some RPG themes that aren’t repetitive…not many.
It was still good (I was too lazy to look at the posts after it).

So this is what we’ve come to, eh? Going into permissions and copyright laws on this site, focused around a small, not-powerful-at-all music tool that produces sub-par audio tracks that was intended to be a fun, enjoyable game? For shame.

Alright, seeing as we’re at this level, I posit to you that the track Kam has made is modified enough not to be a derivative work (which would require licencing and royalties, of course). It borrows the small motif of the red damant and the chord progression, but most other things, including drum beats, instrument tracks and general audio are different enough that he doesn’t have to ask you for permission at all. Claiming you made something that you didn’t is an entirely different matter, but he was very explicit about the fact that it’s a remix, and credited you very obviously as well. It would be different if he used the entire structure of the song, and barely changed anything (for example, still using ALL phrases and solos in their original form, but changing the instruments or tempo or just making modifications to the structure), but he didn’t.

I remember Unknowned used to get really pissy about people using his stuff (although to be fair he seemed pretty pissy in general), and to be honest he seemed like a bit of an ass for it. I’m not saying you’re anything like that, but it’s a slippery slope, so be careful. It’s not like we’re making high-grade, high-fidelity music that we plan to commercialise, so it’s not like you’re losing anything from him remixing your stuff. I’d even go so far as to say you’re gaining publicity for your own stuff. Can’t we all just get along? We’re just messing about with a small game and sharing the stuff around. All this copyright shit only serves to make people defensive and segregate the community when fights break out over “fair use”.

Yeah, yeah, I get pretty rant-y about copyright stuff. To be honest I think a lot of “intellectual property” laws are all bullshit anyway, so feel free to disagree if you think I’m being biased.

I get bored often on this site. I don’t entirely disagree with you. I just usually want people to reassure that this song is allowed for use. Kaveman’s “As The World Falls” was remixed by me, yet I still did ask him. (Then again, I guess you can call it me just editing the song.)
I think most of the copyright laws we have today are fairly okay (but not even close to perfect). Truthfully, I DID post up something on my song list saying that these songs are THEFinalBoss’s use, and using them requires his permission. If we just ignore those things, people like Jhoan Manuel will keep doing what they are doing.

Oh, sorry, I clearly should’ve focused solely on that part of that particular point in the post, and not the whole self-righteous, not-actually-lawful “song used here without permission”, “Gah, ask before you use my song” and “be more careful in future”.

Oh sorry, did I? Could you point out specifically where I said that? And the “For shame” part was more of a light jibe than anything. I didn’t intend for you to think that was a serious insult, but I’m sorry if it came across that way. The reason I’m “not saying you’re anything like that” is because at least you had the decency to be amiable and mostly polite about the whole thing, whereas iirc Unknowned was more vociferous about the whole matter, which to be quite honest got on my nerves a little.

Now, this part I don’t understand. It’s not like anyone’s registered and trademarks on these songs (to warrant the various symbols, y’know, the R’s and the TM’s) because they cost money, and who’s going to pay money to protect this stuff? Ergo, any stuff you make automatically is only at the level of “intellectual property”, as in you created the idea of the song, you made the song, therefore you have the rights to the composition… I’m not sure about the audio rights, because Star hasn’t written an EULA for this software (which should be in the “terms” at the bottom but that’s just a link to the page you’re on). I think by default, if those licencing terms haven’t been defined, you hold the rights to anything you make with the software. Now. Because you haven’t specifically made a move to protect those riffs and chord progressions (can’t trademark chord progressions anyway unless they’re really really specific), they’re available for someone to come along and use those, as long as they use them in the right amount, modify them enough so they can be distinguished as an individual work, and call it a remix. If someone didn’t modify the stuff enough and it still sounded and felt very close to your original work, then that would be a “derivative work”, which isn’t allowed unless you specify that you’ve released it under an appropriate creative commons or equivalent licence that allows derivative works.

Jhoan Manuel made derivative works - he retained a lot of the same instruments, a lot of the same ideas, but simply changed the tempo or added in a few fade ins here and there. THAT is bad. Kamarai here, however, took the effort to only borrow the chord progression and that small damant riff and transform the song using different instruments and an entirely different structure, and there’s nothing wrong with that. The reason you might want to make it clear that you own the rights to the song is so that people like good ol’ Jhoan don’t come along and completely steal your stuff, but it doesn’t apply in the slightest to remixes that people like Kamarai make, and he doesn’t have to ask your permission, because as long as he credits the original source he isn’t breaking any laws.

Already sort of addressed these issues in the above paragraphs but don’t want you to feel like I ignored the points. Read from the last paragraph if you didn’t bother reading the entire thing (which I probably wouldn’t have).

I like the publicity for my thread, and its keeping it on the top page… but arguing turns people away from my OP and they just read what people argue about…
